# Appointing an Outsourced DPO: What to Look For and What to Avoid

Published by [Trust Keith](https://resources.trustkeith.co/author/trust-keith) on Oct 21, 2026, 3:52:23 PM

> **Quick answer:** When you're appointing an outsourced DPO, look for genuine independence, UK GDPR expertise, experience in your sector, and a proactive approach rather than a once-a-year check-in. Make sure they can cover the tasks set out in Article 39, and that there's a team behind them so cover never lapses. Steer clear of anyone who treats the role as a one-off project, can't show relevant references, or has a conflict of interest.

## **Why Outsourcing the DPO Role Is Increasingly Common**

Here's a familiar scene. Your business hits a certain size, someone asks "who's actually our DPO?", and the room goes very quiet.

That moment usually arrives with growth. More customers, more suppliers, more data, and suddenly privacy questions are landing faster than anyone can answer them. Hiring in-house feels like the obvious fix, but it' often not the simplest one.

The law doesn't actually require your DPO to be an employee. [Article 37](https://gdpr-info.eu/art-37-gdpr/) of the UK GDPR says the role can be filled by a staff member or by someone working under a service contract. That's the legal green light for outsourcing.

So why do so many UK scale-ups go that way? Usually, it comes down to the trade-off between two options.

### **In-house: deep knowledge, but fragile**

An in-house DPO knows the business inside out and is around at short notice. That's a real strength. The weakness isn't competence, it's continuity. Independence is hard to keep when the same person also holds an operational role, and there's no cover if they go on leave or leave the company. When they're out, nobody else knows the job well enough to step in.

### **Outsourced: independent, and honest about the cost**

An outsourced DPO sits outside your day-to-day structure, which gives you genuine independence. And outsourcing the DPO role is continuous, ongoing work, just like an in-house hire. They act as your DPO, week in and week out, only from outside the building. The honest trade-off is that it can cost more than an in-house hire, and it needs a clear structure to work well.

Neither option is wrong. But if you're weighing them up, it's worth knowing exactly what you're buying.

## **What an Outsourced DPO Must Legally Be Able to Do**

Whoever you appoint, the job description doesn't change just because they're external. The role comes with legal requirements, and an outsourced DPO needs to meet every one of them.

[Article 39](https://gdpr-info.eu/art-39-gdpr/) sets out the core tasks. In plain English, your DPO must be able to:

- **Inform and advise**, your business and the people handling personal data, on their obligations under data protection law.
- **Monitor compliance**, including your policies, staff awareness and training, and internal audits.
- **Advise on DPIAs**, and keep an eye on how they're carried out.
- **Cooperate with the ICO**, and act as the contact point for the regulator.

There's more to it than the task list, though. The DPO needs to report to the highest level of management, be involved properly and early in anything touching personal data, and have the resources to do the job. And they need to be able to act without being told what conclusion to reach.

That last point is where outsourcing earns its keep. It's much easier to say "no, this needs a DPIA" when you're not worried about your next performance review.

If a provider can't clearly explain how they'd cover each of these, that's your first sign to keep looking.

## **Outsourced DPO vs Privacy Consultant: What's the Difference?**

These two get muddled constantly, but they shouldn't, because they're different things.

A privacy consultant is typically hired for a defined piece of work. A gap analysis, a data protection audit, a sprint to get ready for due diligence. Those are fixed-scope compliance projects, and they're genuinely one-off. You brief them, they deliver, they leave.

An outsourced DPO is a different animal entirely. It's an ongoing appointment. They're named as your DPO, they're accountable for the tasks above, and they stay with your business as it changes. New product launch? New supplier? A breach at 4pm on a Friday? That's their territory.

Here's a quick test. Ask yourself: "Is this something with a start and an end?" If yes, you're probably looking at a project. If it's something you need to keep happening every month for as long as you're processing personal data, you need a DPO.

Some providers blur the line, selling a project and calling it a DPO service. Be wary of anything that's really an annual review in a nice jacket.

---

## **What to Look For in an Outsourced DPO**

Right, the practical bit. If you're evaluating providers, this is the checklist worth taking into every conversation. The [ICO's guidance on data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/) is a useful companion while you do.

- **Qualifications and UK GDPR expertise**, because UK law has its own quirks. A DPO who's mostly worked to EU rules may miss them.
- **Sector experience**, because fintech, healthtech and HR tech all carry different risks. Ask what they've handled in your sector.
- **A proactive approach**, meaning someone who spots issues before they land, not someone who waits for you to send a question.
- **Platform support**, since a DPO working from spreadsheets and email threads won't scale with you. Look for proper tooling for data mapping, ROPA, DPIAs, DSARs and incident management.
- **Continuity**, because you want to know what happens when your named DPO is ill, on holiday or moves on.
- **References**, from businesses of a similar size. Real ones, who'll actually pick up the phone.

That continuity point is the one people forget to ask about, and it's the one that matters most. A single freelancer can be brilliant and still leave you exposed the week they're unavailable.

It's why Trust Keith's outsourced DPO service is continuous, ongoing support, not a one-off project. Customers get an expert matched specifically to their business, who gets to know their processing the way an in-house hire would. But that expert sits outside the business, so independence is built in. And they're backed by a full team of DPOs, so if they're ever unavailable, someone else steps in immediately. Cover never lapses, and neither does momentum.

## **Red Flags When Hiring an External DPO**

Good providers are easy to spot once you know what bad ones look like. Watch for these.

### **A conflict of interest**

[Article 38](https://gdpr-info.eu/art-38-gdpr/) says a DPO can't be given other tasks that create a conflict of interest. If your provider also builds your systems or sets how your data gets used, they'd be marking their own homework. Ask directly how they manage this.

### **One person, no backup**

If everything depends on one individual, you've simply swapped one single point of failure for another. Ask who covers when they're away. If the answer is "I'll check my emails", that's not cover.

### **Vague answers about what's included**

"Ongoing support" can mean anything. Does it include DSAR handling? Breach response? Supplier reviews? Training? Get it in writing.

### **No sector experience**

Generalists can be great. But if your business handles sensitive data at scale, you want someone who's seen your kind of problems before.

### **Reporting that's all paperwork**

Pretty reports are nice. Clear actions, owners and deadlines are better. If you can't tell what's changed after a quarter, something's off.

## **Frequently Asked Questions**

### **Can a DPO be outsourced under UK GDPR?**

Yes. UK GDPR allows the DPO to be a member of staff or to carry out the role under a service contract. Whichever route you choose, they need to meet the same requirements around expertise, independence and access to senior management.

### **What's the difference between an outsourced DPO and a consultant?**

A consultant is usually hired for a fixed-scope project, such as an audit or gap analysis. An outsourced DPO is an ongoing appointment. They act as your DPO continuously, handling advice, monitoring and regulator contact as your business changes.

### **Is an outsourced DPO more independent than an in-house one?**

Often, yes. Because they sit outside your operational structure, there's less pressure on them and less risk of a conflict of interest. An in-house DPO can still be independent, but it takes careful structuring, especially if they also hold another role.

### **What happens if my outsourced DPO is unavailable?**

It depends entirely on the provider. A lone freelancer may leave you without cover. A provider with a team of DPOs behind each named expert can bring someone else in immediately, so there's no gap.

### **How do I know if a provider is the right fit?**

Ask about UK GDPR expertise, sector experience, how they handle conflicts of interest, who covers absences, and what's included in the fee. Then talk to a couple of their existing customers. If the answers are clear and consistent, that's a good sign.

Picking a DPO isn't a box-ticking exercise. It's choosing the person, and the team behind them, who'll help keep your business on the right side of the rules while you get on with growing. The aim is the best of both worlds: the depth of someone who knows your business, with the independence of someone who sits outside it, plus a team behind them so you're never left without cover.
